A Câmara aprovou nesta quarta-feira o projeto de lei que permite que presos em regime aberto, semiaberto ou fechado possam descontar um dia de pena a cada 12 horas de estudo.



Somente os condenados por crime hediondo não terão direito à possibilidade de remição de pena. Agora, o texto seguirá para o Senado.

Os detentos já têm atualmente direito à remição no caso de dias trabalhados, na proporção de 3 dias de trabalho por 1 dia de pena. Parte dos juízes também têm aceitado descontar dias da pena em função de horas de estudo com base em uma súmula do STJ (Superior Tribunal de Justiça).

Se o benefício for aprovado no Senado, os detentos poderão frequentar curso de ensino regular ou de educação profissional, mas terão de comprovar a frequência mensal. No caso dos presos do regime fechado, está prevista a possibilidade de aulas à distância ou dentro do presídio.

O projeto prevê ainda que, em caso de falta grave, o juiz poderá anular até um terço do tempo remido.

Dados do Depen (Departamento Penitenciário Nacional) mostram que 66% dos presos no país não completaram o ensino fundamental. Cerca de 25 mil são analfabetos.
